Our Cancellation Policy

All customers who make a booking with Kidz Smile.co.uk accept the terms and conditions here written, known as our “cancellation policy” subject to our standard terms and conditions and our hire agreement.
We understand that sometimes, for one reason or another you have to cancel your booking. With that in mind our cancellation policy is detailed below.
For Personal Customers:
Free of Charge Cancellations:
1. If it rains on your hire day and you call us to cancel before 8am, we’ll cancel your booking free of charge and release you from any obligation to pay for that booking.
2. If you cancel your order within 7 days of receiving a confirmation email, you may cancel free of charge. We will release you from any obligation to pay for that booking.
3. All deposits are non-refundable unless otherwise authorised. A credit note will be issued for the full deposit amount.
Cancellation fees:
The following cancellation fees are payable under the following circumstances:
1. If you place an order then cancel it 7 or more days after the booking was confirmed but more than 48 hours after the delivery is due to take place, 30% of the order value will be due.
2. If you place an order then cancel it between 48 hours and twenty four hours before delivery is due to take place, 50% of the order value will be due.
3. If you place an order then cancel it less than 24 hours before delivery is due to take place, 100% of the order value will be due.
4. If we arrive to deliver your inflatable on your hire day, but are unable to set it up due to an insufficient space being provided (see full terms and conditions for full description of sufficient spaces) 100% of the order value will be due.
5. You accept that any fees due owing to cancellation may be automatically debited from the credit or debit card which you use when placing the order.
Hire Terms and Conditions
Cancellation Policy, Hire Terms and Conditions, and Contract Conditions of hire/sale apply once a booking has been accepted, either verbally or in writing.
It is the responsibility of the hirer to inform users of our equipment the following rules
· Before making the bookings please ensure that there is enough space for the equipment. The bouncy castles need an additional 4ft gap in front of the castle (for easy access) and a 4ft gap behind the castle for the blower. Also a 2ft additional gap is required on both sides. If Kidz Smile arrives to deliver and setup the inflatable and there is not sufficient room to setup, 100% of the order value will be due as written in our cancellation policy.
· When Hiring the Gladiator duel The Gladiator bouncy bed should have plenty of clear space all around, at least 10ft but preferably a lot more, spectators should be kept a similar distance away. When wrestlers fall they can easily fall or roll off the inflatable
· Make sure all the protection supplied is being worn. Make sure that the helmet is being worn and is securely fitted onto the user’s head, not too tight so as to choke but it shouldn't be loose or able to move around freely, it should be secure.
· The Gladiator helmet is 'one size fits all'. This must be worn at all times.
· Ensure there is adequate First Aid equipment available before using the equipment.
· On the day of the booking please ensure that there are no obstructions/hazards including stones, overhanging tree branches, sharp bushes, broken glass, animal excrement etc around the area.
· To avoid choking, mess or damage to the castle, food & drink, chewing gum etc must not be used on our equipment.
· All shoes, badges, jewellery, hard toys, and sharp items MUST be removed. It is also recommended that spectacles are removed.
· No party-poppers, coloured streamers or "silly string" must be used near or on the inflatable, as they can make a terrible mess and permanently stain the unit.
· Equipment returned in a dirty condition will be subject to a £25 cleaning charge.
· No smoking near the inflatable.
· Somersaults and rough play are strictly prohibited Climbing, hanging, or sitting on the walls is DANGEROUS and must not be allowed.
· Children must be supervised by a minimum of 1 responsible adult on inflatable and around equipment at all times.
· Ensure that the inflatable is not overcrowded, and limit the numbers depending on age and size of children using it. If the children are colliding into each other then it is too crowded. No Adults on children’s castle. You will be charged if adults are caught jumping on a children’s inflatable.
· Avoid large children and small children from using the inflatable at the same time. Some children require strict supervision.
· Do not allow anyone to bounce on the step/front apron. The step is there to help users get on and off.
· Ensure that no-one with a history of back or neck problems are allowed on the inflatable. Pregnant women must also not use the bouncy castles.
· Do not allow users to be on the unit during inflation or deflation. Please ensure the equipment is inflated for when our staff arrive to collect it.
· If you are unsure about anything, please contact us.
· Rain covers are for light showers only; the inflatable should not be used in heavy rain. We will not be held responsible for bad weather ruining your day.
· In the event of winds exceeding 38km/h (Force 5 Beaufort Scale), the unit should be deflated immediately and then re inflated once the winds subside. Beaufort Scale description = Fresh Breeze – Small trees in leaf begin to sway"
· Customers cancelling any booking with are subject to the terms and conditions of our cancellation policy. Verbally agreed to terms and conditions YES NO
The Hirer is responsible for the safe keeping of the inflatable and you will be charged for theft or any damage caused to it or for any items missing from it on its return. Inflatable's being kept overnight must be locked away to avoid theft, again a charge for any missing items will be made.
DISCLAIMER: Please note that all persons using this inflatable do so at their own risk. The person/organization hiring the equipment will be responsible & liable for any damage or injury occurring from or as a result of misuse or reckless use. These guidelines are for the safety of all people using this equipment, and it is the sole responsibility of the hirer to ensure they are adhered to. We cannot accept any responsibility for any injury caused to anyone using this equipment.

Kidz Smile Contract Conditions of Hire & Sale
1. General
a. Definitions
The Contract is for the hire of items and accessories ("Equipment") and the sale of 'resale' goods ("Goods") detailed in the Contract, and the parties to the Contract are:
i. The person(s), firm, company or other organisation hiring the Equipment and/or purchasing the Goods ("Hirer").
ii. Kidz Smile offices at 218 Tamworth Lane, Mitcham, Surrey CR4 1DF ("Kidz Smile").
Any condition deemed invalid will not affect other conditions. Nothing in the Contract is intended to limit a consumer's existing legal rights.
b. Extent of Contract and Cancellation
The Contract is not assignable and is effective when Kidz Smile accepts the Hirer's detailed order. Kidz Smile reserves the right to charge for cancellation, cancellation fees will be charged at a rate equal to a percentage of the total hire fee. Hires to individuals or partnerships of individuals (or other unincorporated body of individuals) shall not be for a period in excess of three months; the Hirer in these circumstances must return the Equipment before the last day of the three month period.
c. Termination
Kidz Smile may terminate the Contract and repossess Equipment without affecting any rights to recover monies due, damages for breach of contract or other remedies where the Hirer is in breach and/or has failed to adhere to the provided Kidz Smile safety instructions and/or is involved in insolvency or liquidation proceedings.
d. Ownership of Equipment and Goods
Equipment hired remains the property of Kidz Smile at all times. Ownership of Goods purchased transfers only when full payment is received by Kidz Smile.
e. Sub Hire Conditions
When Kidz Smile acts as managing agent for the sourcing of Equipment, specific conditions may apply. The Hirer will be advised prior to Contract commencement and those conditions will apply concurrently with these conditions.
f. Jurisdiction
This agreement shall be governed by and construed in accordance with the Laws of England and the parties hereto submit the exclusive jurisdiction of the English Courts.
g. Amendments
Kidz Smile reserve the right to make reasonable amendments to this contract without giving notice to the other party or parties.
2. Hire Charges
a. Basis of charging
The hire charges quoted at the time of booking and/or in the ‘Confirmation Email’ and/or in the contract are for the duration of the Contract and include Saturdays, Sundays and Public Holidays. The amount of any deposit or charges is based on the current price on Kidz Smile website and these prices may change from time to time.
b. Transport & Set up charges
Delivery, set up and collections including attempted calls are chargeable. If Equipment is not available or only partially available for collection then the Hirer will be charged for each journey.
c. Deposits
Deposits are set by Kidz Smile at amounts reasonably required and will be offset against any monies due. Where a Deposit is required for the Equipment it must be paid by the Hirer before the hire period. Deposit balances are refunded upon return to Kidz Smile of Equipment in good condition. Balances of deposits paid by cheque will be refunded by cheque or BACS transmission within 7 business days.
d. Cleaning and damage repair
The Hirer will pay for required cleaning and/or repair and, except where appropriate conditions in 4(a) or 4(b) apply, breakages and damage repair.
e. Loss of Equipment
Kidz Smile will treat Equipment unavailable for inspection after reasonable notice as lost and except where appropriate conditions in 4(b) apply the Hirer will pay a penalty charge for Equipment replacement and revenue loss. Hire charges accrue until full settlement is made.
f. Waiting Time & Access
Coherent to clause 5b. Where Kidz Smile are required to deliver and/or collect equipment from the hirer and inadequate access is provided, Kidz Smile may charge a fee for:
a. Waiting Time – Where the customer is not ready to accept the delivery at the time Kidz Smile representatives arrive or if the equipment is not ready for collection when Kidz Smile representatives arrive.
b. Extra Time and/or Extra Work and/or Inconvenience and/or additional staffing and/or additional transport: Where Kidz Smile have to deliver and/or collect equipment using unsuitable access resulting in any of the previous.
g. Billing Card Authorisation
During the booking process Kidz Smile may obtain credit/debit card details from the customer. The hirer authorises Kidz Smile to charge this card for the full value of any charges which Kidz Smile may accrue which remain unpaid at the end of the hire period.
3. Payment
a. Payment Terms
If KIDZ SMILE has granted a credit account to the Hirer then payment of any charges or any other sums due under the Contract, including VAT, shall be made in full cleared funds by the end of the month following the date of the invoice. Where a credit account has not been granted then payment of any charges or any other sums due under the Contract shall be made with the Hirer's order for the Equipment or Goods. Payment by the Hirer on time under the Contract is an essential condition of the Contract. Payment shall not be deemed to have been made until Kidz Smile has received cleared funds or cash. Purchase transfers only when full payment is received by Kidz Smile.
b. Invoice Queries
The Hirer should notify Kidz Smile of any queries concerning invoices in writing within 14 days of the invoice date. Kidz Smile will not grant an extension to credit account payment terms for unresolved invoice queries that have been notified after 14 days have elapsed from the invoice date.
c. Overdue Accounts
Should any portion of an account fall overdue then the total account will become due on demand. The Hirer will be liable for reasonable legal charges incurred by Kidz Smile in the recovery of amounts due, Equipment and/or Goods. In addition Kidz Smile may charge interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1988 at Bank of England base rate plus 4% and/or may suspend further services to the Hirer.
d. Credit Limits
Where Kidz Smile has granted a credit account to the Hirer, Kidz Smile may set a reasonable credit limit. Kidz Smile reserve the right to terminate or suspend the Contract if allowing it to continue would result in the Hirer exceeding his credit limit or the Hirer has already exceeded his credit limit.
4. Damage Waiver
a. Damage Waiver
The 'Damage Waiver' charge, at 10% of the hire charge, (where available as an option) will be added to the contract unless the Hirer specifically requests otherwise or if Kidz Smile are unable to offer damage waiver for any reason at the time of order. Under 'Damage Waiver' Kidz Smile will waive any further charge for rectifying accidentally damaged returned Equipment. If the Hirer does not take 'Damage Waiver' then condition 2(d) will be enforced. 'Damage Waiver' is not an insurance for Equipment loss or theft. 'Damage Waiver' may be limited under Kidz Smile Sub Hire Contracts and 'Damage Waiver' may be invalidated where condition 5(d) and/or 5(e) is not adhered to.
b. Limit of Claim - 'Damage Waiver' does not protect the Hirer for:
a. The first £40 (or 20% whichever is the greater amount) of any Equipment damage claim.
b. Any claim for damage to the Equipment if:
i. The Equipment was left unattended overnight outside a secure compound or building or stored overnight in a secured vehicle.
ii. Any persons were under the influence of drugs and/or alcohol at the same event that the equipment was being operated.
iii. The damage was intentional.
5. Hirer’s Responsibility
a. Inspection and receipt of Equipment and Goods
The Hirer will sign to acknowledge receipt at delivery/handover. Shortages must be agreed and noted on the Contract/delivery document. Equipment defects should be reported to Kidz Smile immediately by telephone.
b. Delivery/collection of Equipment and Goods
The Hirer will provide adequate delivery and collection access. Equipment transported in the Hirer's own vehicle is at the Hirer's risk. If Kidz Smile are delivering and/or collecting equipment to/from the hirer’s premises and access is inadequate (inadequate access defined as follows) then the hirer may be liable to pay an additional fee as per clauses under section 2 or the booking may be terminated under clause c section 1.
a. Where equipment cannot fit through an 80cm wide door way.
b. Where BCHire staff are required to walk more than 75m on foot from their vehicle to the point where equipment needs to be delivered or collected.
c. Where the route to the equipment isn’t completely clear of obstructions including but not limited to waste, branches, furniture and/or people.
d. Where equipment must be walked/dragged/pulled/pushed up and/or down any steps or stairs.
c. Security of Equipment
The Hirer accepts responsibility for Equipment security until its collection by or returns to Kidz Smile and undertakes not to sell or relinquish possession, alter, repair or modify it in any way.
d. Suitable Space
The hirer agrees to provide a suitable space for the equipment hired according to advice given on Kidz Smile website and/or given in any correspondence sent to the hirer and/or provided at the time of booking by any other media.
e. Safe use of Equipment and breakdown procedure
The Hirer is responsible for the safe and correct operation of Equipment (conforming to relevant legislation and the Kidz Smile operating and safety instructions supplied) by competent persons not under the influence of alcohol or drugs and for its constant supervision within the range of children. The Hirer will immediately notify Kidz Smile of any Equipment breakdown or shortcoming without attempt at repair. The Hirer will ensure any non-Kidz Smile Equipment used in conjunction with or attached to Equipment also conforms to safety requirements.
f. Return or collection of Equipment
The Hirer may arrange for the return or collection of Equipment with any Kidz Smile outlet during normal business hours and when Equipment has been returned or collected Kidz Smile will issue a return note. The Hirer will remain liable for ongoing hire charges until such return note has been issued. When the Hirer requests collection of Equipment Kidz Smile will issue a 'collection reference number' in acknowledgement, the Hirer remaining responsible for the Equipment, and in particular its security, until actual collection.
g. Lost or stolen Equipment
Except where the Hirer opts for 'Damage Waiver Plus' (where available as an option) under condition 4(b) the Hirer agrees to insure Equipment on a full replacement basis against the risks of loss, theft and damage beyond economic repair and on demand to pay to Kidz Smile any insurance claim proceeds. This liability is without prejudice to any Kidz Smile rights under the Contract. Replacement equipment purchased with insurance claim proceeds is the property of Kidz Smile.
6. Kidz Smile Responsibility
a. Hire rates
Kidz Smile will maintain the agreed hire rates for the duration of the Contract.
b. Safety and operating instructions
Kidz Smile will provide appropriate written and/or practical instruction in the safe and correct operation of Equipment.
c. Testing and inspection of Equipment
Kidz Smile will comprehensively test all electrical Equipment before commencement of hire. Equipment will be inspected and tested where appropriate in accordance with relevant statutory requirements and if Equipment needs to be recovered from the Hirer for such purposes Kidz Smile will substitute items of similar specification.
d. Delivery and collection
Following the Hirer’s request, Kidz Smile will endeavour to deliver or collect Equipment on time, wherever possible.
e. Returned Goods
Kidz Smile will arrange an appropriate credit where the Hirer returns in unused condition Goods sold for use with Equipment.
f. Limitation of liability
The liability of Kidz Smile for claims made by the Hirer does not extend to any unforeseeable financial loss caused by late or non-delivery of Equipment and/or Goods, unsuitability, breakdown, stoppage or lawful repossession.
Kidz Smile Marquee– Terms of Hire
Two party marquees are available for hire. They are made of white lightweight vinyl with adjustable sides and windows on aluminium frames.
Their sizes are:
3 metres x 9 metres
4 metres x 8 metres

Erection of marquees
Laminated instructions for erection of marquees will be provided and be erected by a Kidz Smile team. Each marquee takes at least one hour to erect with a team of four.
Insurance
Once the marquees have been erected and customers have agreed terms Kidz Smile marquees are not covered by Kidz Smile insurance. The hirer is responsible in full for damage or loss, and is recommended to arrange insurance in advance. Replacement value is £300 - £400 according to size.
Insurance is usually negotiable with your own insurers and may already be covered by the indemnity clause on your current household insurance. If this is not the case it is customary to be able to arrange a short-term extension.
Collection and return
The marquees, poles and connections etc are stored in large made to purpose bags at Kidz Smile.
Each set occupies three bags for poles and three or four bags for marquee, connectors and pegs, all which would fit in an estate or large hatch back car. It is essential that two to 4 people come to collect the marquees, as some of the bags are heavy and unwieldy.
It is expected that the tents will be returned in the same condition as they were left in, that is clean, dry and undamaged. IT IS CRITICAL THAT THE TENTS ARE NOT PACKED OR STORED WHEN WET. In the case of rain a delay in collection should be negotiated, the same will apply in erecting and dismantling in windy weather. All sides of marquee are to be closed during overnight hire to avoid wind damage. There is to be no smoking inside marquee.

6ft rectangular tables available for hire subject to availability. Tables charged at £5.00 per table.

Terms and conditions
Face Painting
We only use professional, high quality, water based face paints from suppliers such as Snazeroo. The paints are hypoallergenic and contain agents which work against yeast, mold and bacteria, and are easily removed from skin and clothing.
We use only Cosmetic Grade polyester glitters, with no metallic content, which are safe for skin and eyes.
Clean sponges are used and brushes are rinsed thoroughly in clean water, which is changed regularly during jobs. Sponges and brushes are washed with hot water and specialist soap between events. We use wet-wipes to clean dirty faces before starting work.
As with any cosmetic product, face paint may cause a skin reaction in a small number of people. In such cases the paint should be removed immediately using mild soap and warm water. Face paint should always be cleaned off after 2 or 3 hours and children should never be allowed to go to bed with a painted face. We accept no liability for adverse reactions to the products used. If in doubt, please ask for a patch test and wait 30 minutes before being painted.
Face paints are recommended for use on children aged three and over., but painting on the cheek, hand or leg may be done on children aged between two and three at the parents own risk. We will not paint children less than two years of age.
No person with cold sores, conjunctivitis, open wounds or any apparent skin disease on the face will be painted. We must also decline to paint any person who is obviously suffering from an infectious illness, cold or flu.
Adult consent is required before any young child can be painted. The client will be deemed responsible for informing the parents of the children present that face painting will be available, and for informing the face painter if any child cannot be painted.
Face painting should be fun - we will only paint children who want to be painted and who are able to sit reasonably still. We will not paint an unwilling child, regardless of what the parent may want!!
Despite being CRB checked, our face painters are not child minders. Parents are responsible for their own children at all times, and at least one adult must be in attendance at all times at private parties.
We may, occasionally, ask permission to take digital photographs of the faces we paint. Such photographs will be retained for the use on our website for advertising purposes. Adult consent will be requested before any child is photographed.
